Testudy provides a platform for users to create, edit, learn from, and share learning tools and study content based on their own data and interests.
2. Agreement to These Terms
By accessing or using Testudy, you agree to be bound by these Terms. If you do not agree, you must stop using the service immediately.
If you use Testudy on behalf of a business or organisation, you confirm that you have authority to bind that entity to these Terms.
Additional policies or supplemental terms we publish for specific features or services may also apply and are incorporated into these Terms by reference.
3. Eligibility
You must be at least 13 years old to use Testudy. If you are under 18, you should use the service with the involvement of a parent, guardian, school, or other responsible adult where appropriate.
4. Our Services and Usage Restrictions
The services are provided for general educational and productivity purposes. You are responsible for ensuring your use complies with applicable local laws where you access the services.
The services are not intended to be relied on for compliance with industry-specific regulatory frameworks (for example HIPAA, FISMA, GLBA) and should not be used in ways that would require us to comply with such frameworks unless expressly agreed in writing.
5. Accounts, Registration and User Representations
- You may need to create an account to use some features.
- You must provide accurate, current, and complete information and keep it updated.
- You are responsible for safeguarding your password and all activity under your account.
- You must not register or use accounts through bots, scripts, or other automated methods unless we expressly permit it.
- We may suspend, reclaim, or change usernames that are inappropriate, misleading, or objectionable.
- We may suspend or terminate accounts if information provided is false, incomplete, or breaches these Terms.
6. AI-Generated Content Disclaimer
Testudy uses AI systems to generate educational content. Outputs may be inaccurate, incomplete, outdated, or unsuitable for your specific circumstances.
You should use independent judgment and verify important information, especially for high-stakes topics (such as medical, legal, financial, safety-critical, or regulated subject matter).
7. Intellectual Property
Testudy, our software, platform design, branding, logos, trademarks, content, and related materials are owned by or licensed to EF Tech Ltd and protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the services for your personal or internal business use.
You must not copy, reproduce, republish, distribute, reverse engineer, resell, or commercially exploit the services or our materials except as permitted by law or with our prior written consent.
8. User Content, Submissions and Contributions
You retain ownership of content you submit to Testudy (subject to third-party rights). By submitting content, you grant us a licence to host, process, reproduce, adapt, and use that content as necessary to provide, maintain, secure, improve, and promote the services.
If you post content publicly (including contributions, forum content, or shared content), you understand that it may be visible to other users and third parties.
You represent and warrant that:
- You own the content or have the necessary rights and permissions to submit it.
- Your content does not infringe third-party rights (including copyright, trade marks, privacy, or publicity rights).
- Your content is not unlawful, deceptive, defamatory, harassing, hateful, or sexually explicit in breach of law or our rules.
- Your content does not include malware or harmful code.
We may remove, edit, restrict, or disable content that we reasonably believe breaches these Terms or may cause harm.
9. Acceptable Use and Prohibited Activities
You agree not to use Testudy to:
- Upload, generate, share, or promote unlawful content
- Upload, generate, share, or promote adult or sexually explicit content where prohibited by law or our platform rules
- Harass, abuse, threaten, intimidate, defame, or harm others
- Infringe intellectual property, privacy, or publicity rights
- Trick, defraud, or mislead us or other users
- Attempt to bypass limits, security controls, or access restrictions
- Scrape, harvest, systematically extract, or compile data from the services without permission
- Use bots, scripts, spiders, or automated tools to access or interact with the services without permission
- Abuse AI features, including prompt attacks or attempts to degrade platform integrity
- Introduce malware, malicious code, or harmful files
- Interfere with, disrupt, or create undue burden on the services or connected networks
- Use the services to compete with us or for unauthorised commercial resale
10. Purchases, Billing and Payment
Paid features and subscriptions may be offered through the services. You agree to provide current, complete, and accurate billing and payment information for purchases.
Prices, taxes, and billing intervals are shown at checkout. We may change pricing from time to time and will communicate material subscription price changes in accordance with applicable law.
Payments and subscription billing are processed by Stripe and may also be subject to Stripe's terms and privacy practices.
We may refuse, limit, or cancel orders where reasonably necessary (for example fraud risk, misuse, or pricing/technical error correction).
11. Subscriptions, Renewal, Cancellation and Refunds
Paid subscriptions renew automatically unless cancelled before the next billing date.
You can manage or cancel your subscription via the Stripe customer portal links provided in the service.
We offer a 30-day refund policy where stated or agreed. After a billing period has started, fees are otherwise non-refundable except where required by applicable law.
Nothing in these Terms affects any statutory rights you may have under UK consumer law.
12. Third-Party Services, Websites and Content
The services may include links to third-party websites, tools, login providers, or content. We do not control and are not responsible for third-party websites, content, or services.
Your use of third-party services is governed by your agreements with those third parties.
13. Service Management, Availability and Corrections
We may monitor the services for compliance, investigate misuse, and take action we consider necessary to protect users, the platform, and our rights.
We aim to provide reliable access but do not guarantee uninterrupted or error-free availability. We may perform maintenance, updates, or emergency changes that affect access.
We may correct typographical errors, inaccuracies, omissions, or pricing/display errors at any time.
14. Privacy and Data
Our use of personal data is described in our Privacy Policy, which is incorporated into these Terms.
You are responsible for maintaining your own backups of important data where appropriate. While we may perform backups or recovery measures, we do not guarantee against loss or corruption of user-submitted data.
15. Termination and Suspension
We may suspend, restrict, or terminate your access if you breach these Terms, create legal or security risk, fail to pay applicable fees, or misuse the platform.
If your account is terminated or suspended, you must not attempt to create another account to circumvent that action unless we expressly permit it.
You may stop using the service at any time.
16. Disclaimer
The services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties (express or implied), including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the services will be uninterrupted, secure, error-free, or free from harmful components, or that content will always be accurate or complete.
17. Limitation of Liability
To the fullest extent permitted by law, EF Tech Ltd is not liable for indirect, incidental, special, consequential, or punitive losses, or for loss of profits, revenue, business, goodwill, or data arising from your use of the services.
Our total liability arising out of or in connection with the services will be limited to the amounts you paid to us for the services in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.
18. Indemnity
If you use Testudy on behalf of a business or organisation, you agree (to the extent permitted by law) to indemnify and hold harmless EF Tech Ltd and its officers, employees, and agents from claims, liabilities, losses, and expenses arising from your misuse of the services, your content, or your breach of these Terms.
19. Electronic Communications
By using the services, sending us emails, or completing online forms, you consent to receive communications from us electronically. You agree that electronic communications satisfy legal requirements for communications to be in writing, subject to applicable law.
20. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date. Your continued use of the services after changes take effect means you accept the revised Terms.
21. Governing Law and Jurisdiction
These Terms and any dispute or claim arising from them (including non-contractual disputes or claims) are governed by the laws of England and Wales.
The courts of England and Wales shall have jurisdiction, except where mandatory consumer law provides otherwise.
22. Miscellaneous
These Terms, together with any policies or rules referenced in them, form the entire agreement between you and us regarding the services.
If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce a provision is not a waiver of that provision.
We may assign our rights and obligations under these Terms. You may not assign your rights or obligations without our prior written consent.
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and EF Tech Ltd.
